Whose Idea Is It Anyway?

It is important to take a moment before you either disclose or receive a disclosure of an idea or other technology to clarify and confirm the terms upon which such disclosure is being made. This is an instance where an ounce of prevention can really prevent a pound of litigation headaches down the road.

 Audits.

Every company, and any individual in business for him or her self, should perform an audit of intellectual property to confirm that all materials are protected by copyrights, trademarks and/or patents as appropriate. I can assist you in performing this task.

Employment Concerns.

Both employees and employers should be concerned about and aware of who owns inventions, discoveries or ideas conceived of by the employees while on the job. Agreements can easily resolve this mystery. Also, special considerations relate to making contracts with independent contractors for creations which you might want to own yourself.
